1 Service Overview

We offer a website where you can purchase digital products such as wallpapers, widgets, and icon packs ("Products").

2 Eligibility

You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 13 years old, have not previously been suspended or removed from the Service, and that your use of the Service complies with all applicable laws and regulations.

3 Accounts & Registration

You can check out as a guest, or create an account to access your purchases and re-download your files at any time. If you create an account, you agree that the information you provide is accurate and that you will keep it up-to-date. You are solely responsible for maintaining the confidentiality of your account and password. If you believe your account is no longer secure, notify us immediately at iskren@hey.com.

4 Payment Terms

Pricing

The Creator reserves the right to determine prices for all Products. Prices may change with advance notice. At its sole discretion, Creator may make promotional offers with different pricing to any customers.

Authorization

You authorize the Creator and its third-party payment processors to charge all sums for the Products you purchase, including all applicable taxes, to the payment method specified in your account.

One-Time Purchases

All Products are sold as one-time purchases. We do not operate subscriptions or recurring billing. Where available, prices are shown at checkout in your local currency; the amount you are charged is the amount displayed at the time you place your order.

5 Returns & Refunds

Our Products are digital goods, delivered electronically and available to download immediately after purchase.

EU/EEA consumers — right of withdrawal: by purchasing a digital Product and beginning your download, you expressly request that we start supplying it immediately and you acknowledge that, as a result, you lose your statutory 14-day right of withdrawal under EU consumer law once the download has begun.

6 Licenses

Limited License

Subject to your complete and ongoing compliance with these Terms, the Creator grants you, solely for your personal, non-commercial use, a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and the Products you purchase. The specific terms that apply to the digital files you buy are set out in Part II — Personal Use License.

License Restrictions

You may not reproduce, distribute, publicly display, or publicly perform the Service; make modifications to the Service; or interfere with or circumvent any feature of the Service, including any security or access control mechanism.

Ownership

All materials, graphics, designs, content, software, and other elements of the Service are protected by intellectual property laws and are the property of the Creator or its third-party licensors. Except as expressly authorized by the Creator, you may not use these materials.

7 Prohibited Conduct

By using the Service, you agree not to:

• Use the Service for any illegal purpose
• Violate any third-party intellectual property right
• Interfere with security-related features of the Service
• Upload or disseminate any virus or malicious code
• Perform any fraudulent activity including impersonating any person or entity
• Sell or transfer the access granted under these Terms

8 Modification of These Terms

We reserve the right to change these Terms on a going-forward basis at any time. Material modifications are effective upon your acceptance of the modified Terms. Check these Terms periodically for changes.

9 Term & Termination

These Terms are effective from when you first access the Service until terminated. If you violate any provision, your authorization to access the Service automatically terminates. Creator may terminate these Terms or your account at any time, for any reason, with or without notice. You may terminate your account at any time by contacting iskren@hey.com.

Upon termination, your license rights terminate and you must cease all use of the Service, you will no longer be authorized to access your account, and you must pay any unpaid amounts due prior to termination.

10 Indemnity

To the fullest extent permitted by law, you will defend and indemnify the Creator and its officers, directors, employees, consultants, affiliates, and subsidiaries from and against every claim brought by a third party arising out of or connected with your unauthorized use of the Service, your violation of these Terms or any applicable law, or your violation of any third-party right.

11 Disclaimers; No Warranties

The Service and all materials and content available through the Service are provided "as is" and on an "as available" basis. The Creator disclaims all warranties of any kind, whether express or implied. You use any portion of the Service at your own discretion and risk.

Nothing in this section affects your statutory rights as a consumer, including any legal guarantee that digital content conforms to its description. Where applicable law does not allow certain warranties to be excluded, the exclusions above apply only to the extent permitted by that law.

12 Limitation of Liability

To the fullest extent permitted by law, in no event will the Creator be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your access to or use of the Service or any materials or content, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory. The aggregate liability of the Creator to you for all claims arising out of or relating to the use of the Service is limited to the greater of the amount you have paid to the Creator in the 12 months prior to the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for fraud, for death or personal injury caused by our negligence, or for any of your statutory consumer rights that cannot be waived.

13 Miscellaneous

Governing Law

These Terms are governed by the laws of Bulgaria without regard to conflict of law principles. You and the Creator submit to the personal and exclusive jurisdiction of the courts located within Sofia. If you are a consumer resident in the EU/EEA, you also keep the protection of any mandatory provisions of the law of your country of residence, and nothing in these Terms deprives you of those rights or of any right you have to bring proceedings in your local courts where the law so provides.

International Use

The Service is intended for visitors located worldwide. We do not represent that the Service is appropriate or available in every country.

1 What This License Permits

• Download and store the purchased files on your own personal devices.
• Set wallpapers on your personal desktop, smartphone, or tablet.
• Use widget files on your own personal device for personal productivity.
• Re-download your files at any time through your account — there is no expiry on access.

2 What It Does Not Permit

The following are strictly prohibited and constitute copyright infringement:

• Redistribution of any kind — you may not share, upload, post, or distribute the files to any other person or platform, whether free or paid. This includes Reddit, Discord, Telegram, Google Drive, WeTransfer, file-sharing sites, torrent sites, or any other platform or medium.
• Resale — you may not sell, license, or sublicense the files to any third party.
• Bundling — you may not include the files in any product, pack, template, or service offered to others.
• Commercial use — you may not use the files in advertisements, client deliverables, broadcast content, merchandise, or any other commercial context without a separate written commercial license obtained directly from the Creator.
• Claiming authorship — you may not present the work as your own creation.
• Derivative redistribution — you may not modify the files and redistribute the modified versions.

3 Ownership & Copyright

Purchasing a product grants you a license to use the files. It does not transfer copyright or ownership of the underlying creative work. All products remain the exclusive intellectual property of the Creator and are protected under applicable copyright law.

4 Single-User License

This license applies to the individual purchaser only. Files may not be shared with or transferred to any other person — including family members, colleagues, or friends — without a separate purchase.

5 Enforcement

The Creator actively monitors for unauthorized distribution and reserves the right to pursue any and all legal remedies available under copyright law in the event of a violation. Unauthorized redistribution — including sharing files on Reddit, Discord, or any other platform — constitutes copyright infringement and may result in a DMCA takedown notice and civil or criminal legal action.

6 Commercial Licensing

If you would like to use a product for commercial purposes, contact iskren@hey.com to discuss a commercial license. Commercial use without a license is not permitted under any circumstances.

1 Who We Are

ThisIsE is a digital products store operated by Incredible Studio Ltd ("we", "us"), based in Varna, Bulgaria. For the purposes of the EU General Data Protection Regulation (GDPR), we are the data controller for the personal data described here. You can reach us at any time at iskren@hey.com.

2 What We Collect

• Information you provide — your name, email address, and billing details when you create an account or place an order.
• Order information — the products you buy, your order history, and your download activity.
• Payment information — card payments are processed securely by Stripe. We never see or store your full card number; Stripe handles it directly.
• Technical information — your IP address and basic browser/device information, collected automatically to keep the site secure and working.
• Messages — anything you send us by email.

3 How & Why We Use It

We use your data only for clear purposes, each with a legal basis under the GDPR:

• To deliver your order and the digital files you bought, and to send order confirmations and download links (performance of a contract).
• To provide customer support and respond to your messages (contract / legitimate interest).
• To send marketing emails — only if you opt in, and you can unsubscribe at any time (consent).
• To meet our tax, invoicing, and accounting obligations (legal obligation).
• To keep the site secure and prevent fraud or abuse (legitimate interest).

4 Cookies

Essential cookies are always active — they remember your shopping cart, your login session, and your light/dark theme preference, and provide payment fraud protection (set by Stripe). The store cannot work without them.

Analytics cookies are only set with your consent. If you accept them in our cookie banner, we use WooCommerce Order Attribution to understand which channels our visitors come from. You can decline these with no effect on your ability to shop, and we never use advertising cookies or sell your data.

Product pages may embed YouTube videos; if you choose to play one, YouTube may set its own cookies (we use the privacy-enhanced youtube-nocookie player where possible).

5 Who We Share It With

We never sell your personal data. We share it only with the service providers we rely on to run the store:

• Stripe — to process payments securely (see stripe.com/privacy).
• Brevo — to send your order emails and, if you opt in, marketing emails.
• Hostinger — to host the website and store its data.
• YouTube / Google — only when you choose to play an embedded video.

We may also disclose data where required to do so by law.

6 International Transfers

Some of our providers (such as Stripe and Google) may process data outside the European Economic Area. Where they do, they rely on appropriate safeguards such as the EU Standard Contractual Clauses.

7 Data Retention

We keep order and invoice records for as long as tax and accounting law requires. We keep your account data until you ask us to delete it, and marketing data until you unsubscribe.

8 Your Rights

Under the GDPR you have the right to access, correct, delete, restrict, or object to the processing of your personal data, the right to data portability, and the right to withdraw consent at any time. To exercise any of these, email iskren@hey.com. You also have the right to lodge a complaint with the Bulgarian Commission for Personal Data Protection (CPDP) or your local data-protection authority.

9 Children

This site is intended for users aged 13 and over. We do not knowingly collect personal data from children under 13.
